The Panel Terms of Use

1. Who we are, and accepting these Terms
The Panel is operated by an individual developer based in the Philippines ("we", "us"), who publishes it through an Apple Developer Program individual account; the developer's legal name is the Seller shown on The Panel's App Store page. Contact: support@appsbynikki.com.
By tapping Sign in with Apple on the sign-in screen, you agree to these Terms of Use, including our Usage Policy, and acknowledge our Privacy Policy. If you do not agree, do not use The Panel.
Language. These Terms, our Usage Policy and our Privacy Policy are written in English. If you are in Québec, by continuing you confirm that you have asked for them to be drawn up in English only. / Si vous êtes au Québec, en continuant, vous confirmez avoir exigé que les présentes conditions, la Politique d'utilisation et la Politique de confidentialité soient rédigées uniquement en anglais.
2. Eligibility
You must be 18 or older to create an account or use The Panel. By tapping Sign in with Apple you confirm that you meet this requirement and that your use complies with the laws that apply to you. The Panel is rated 18+ in the App Store. Where a law requires it, the app also asks Apple for your age range when you sign in (Privacy Policy §3); if Apple tells us the person using the device is under 18, The Panel won't let them continue.
The Panel is currently offered only in these storefronts: United States, Canada, Australia, New Zealand, and Singapore. We are not offered in mainland China.
An account is required before you can use any part of the service: there is no guest or trial-without-signup mode.
3. The service
The Panel asks several independent AI systems ("Panelists") a question, or asks them to assess an AI answer you submit, and produces an analysis layer above their individual answers. Key terms, as used throughout these Terms and in the app:
- Panel: the set of independent AI Panelists used for a given run.
- Panelist: one AI participant (currently presented to you as ChatGPT, Gemini, Claude, and Grok; the AI companies that receive your content are named on the AI provider sharing permission screen, and every company that processes it is named in the Privacy Policy).
- AI provider: the company operating a Panelist (OpenAI, Google, Anthropic, and xAI, which also trades as SpaceXAI).
- Panel Check: one standard multi-model analysis, used by both Ask and Second Opinion.
- Panel Run: the backend execution record for a Panel Check.
- Panel Verdict: the synthesized result of a Panel Check.
- Model Consensus: the degree and nature of agreement among Panelists on a run. This is a measure of AI-to-AI agreement, not a measure of truth, accuracy, or confidence.
- Dissent / Minority View: a materially different position held by fewer Panelists on a claim. A Minority View is not automatically wrong.
- Second Opinion: the Panel's independent assessment of an AI answer you submit, including The Panel's Revised Answer where produced.
- Evidence checking against outside sources is not part of the service. The Panel compares AI answers with each other; it does not look anything up. Nothing in these Terms or in the app promises such a feature; if one is added, its own terms will be disclosed first.
What the service does not do
The Panel does not show token costs, provider routing details or internal orchestration in the ordinary product experience. If a Panelist fails to respond or a run only partially completes, the app says so rather than presenting a falsely complete result. Every answer, Panel Verdict and analysis in The Panel is produced by AI systems; none of it is written or checked by a person.
4. AI output disclaimer
Panel Verdicts, Model Consensus, claim analysis, Original Responses, and every other output are generated by third-party AI systems and by our own analysis of their outputs. They may be inaccurate, incomplete, outdated, or misleading.
- Strong Model Consensus is not proof that an answer is correct. It means the AI Panelists agreed with each other, not that the answer is factually accurate.
- A Minority View does not mean that Panelist is wrong. Dissent can be valuable and is not penalized or hidden.
- An individual Panelist's response reflects that AI provider's own system, not The Panel's own views, opinions, or endorsement of any claim, product, or course of action.
- The Panel is not a substitute for professional advice. Do not rely on The Panel for medical, legal, financial, tax, safety-critical, or other advice that should come from a licensed professional. Always use independent judgment and verify important information before acting on it.
- Crisis and emergency resources. The Panel may display contact details for third-party crisis and emergency services (for example, in the Crisis support sheet) for your convenience. In doing so, The Panel only signposts these independent resources: it does not provide, operate, supervise, or control them, and this listing does not imply any affiliation, endorsement, or partnership between The Panel and the organizations shown. Availability, eligibility, phone numbers, and service terms for any listed resource may change, and a listed service may only be available in the country shown next to it. The Panel is not a crisis, medical, or mental-health service and is not responsible for the availability, conduct, advice, or outcomes of any third-party service it signposts. Contact details are provided in good faith and periodically reverified against official sources, but may still be out of date; if a number doesn't work, contact your local emergency services. If you or someone else is in immediate danger, call your local emergency number.
5. Acceptable use
Follow our Usage Policy, which is part of these Terms. It explains what you can't use The Panel for, how we check questions and answers, what counts against your account, and when we close accounts.
You also agree not to:
- attempt to extract, discover, or reverse-engineer AI provider API keys, credentials, internal model identifiers, or routing/orchestration details that the app does not expose to you;
- circumvent or interfere with rate limits, spend controls, or abuse-prevention measures (for example, creating multiple accounts to obtain additional free-trial Panel Checks);
- use the service in a way that violates the acceptable-use requirements the AI providers who answer your questions place on us;
- use automated tools, scripts or scrapers to access The Panel, or copy results in bulk;
- present a Panel Verdict or any AI answer as written or checked by a person;
- use The Panel from a place, or for a purpose, that sanctions or export laws forbid.
We may suspend or close access for violations of this section or the Usage Policy, as §11 and the Usage Policy describe.
6. Your content
You retain ownership of the questions, submitted answers, and context you provide ("Your Content"). By submitting Your Content, and after you grant provider-sharing permission as described in the Privacy Policy, you grant us (and, through us, the AI providers and routing intermediary described in the Privacy Policy) the limited license needed to transmit, process, and analyze Your Content solely to operate the service and produce your result. This license ends when the corresponding content is deleted as described in the Privacy Policy, except to the extent a provider's own copy is governed by its own retention terms, which we do not control.
Only include personal or sensitive information, such as health details, if your question needs it, and don't include other people's information unless you have the right to share it.
Results. We don't claim ownership of the Panel Verdicts, Original Responses and Revised Answers you receive; to the extent we have any rights in them, we assign them to you, and you may use and share them. Three things to know: AI results may not be unique, so other people may receive the same or similar results; results may not be protected by copyright, or may reproduce third-party material; and sharing a result doesn't change the disclaimers in §4. Each AI provider's own terms govern its copy of your question and its answer (Privacy Policy §6).
7. Accounts
- You must sign in with Sign in with Apple to create an account; no other sign-in method is offered.
- You are responsible for activity that occurs through your Apple ID and device.
- One account per person. Creating multiple accounts to obtain additional free-trial Panel Checks is not permitted (see §5); we use a keyed, non-reversible fingerprint of your sign-in identity to prevent this, described in the Privacy Policy.
- If we've closed your account under our Usage Policy, don't open another one, and don't use someone else's account.
8. Subscriptions and billing
Free
- 3 Panel Checks, granted once, that never reset. If your Pro subscription lapses, you fall back to whatever remains of this one-time trial. It is not re-granted.
- The free Panel Checks are not a trial subscription. Using them never signs you up for anything or leads to a charge. You pay only if you choose to buy The Panel Pro or a credit pack.
The Panel Pro
- $11.99/month or $109.99/year (US storefront pricing; prices in other storefronts are set in the App Store and may differ; the annual price is also expressed as an approximate "$9.17/month equivalent," which describes the annual price divided by twelve, not a separate monthly billing option).
- 50 Panel Checks per monthly allowance period. The monthly allowance period is separate from your billing cycle: it runs from the date you subscribed and resets on that same date every month (for example, if you subscribed on the 14th, your allowance resets on the 14th of each month; if your subscription date falls on the 29th, 30th or 31st, we use the last day of any shorter month, then return to that date once the month is long enough again). Annual subscribers still receive a fresh allowance every month on their subscription date, not once a year. Do not read "$109.99/year" as meaning your usage resets only once a year: it resets monthly regardless of whether you pay monthly or annually.
Top-up credits
- You need an active Pro subscription (including its billing grace period) to buy a pack. Pro subscribers can buy extra Panel Checks, shown in the app as credits, in packs of 50 (1 credit = 1 Panel Check). The price is shown in the App Store for your storefront. You can buy up to 2 packs in each monthly allowance period (§8, The Panel Pro).
- Your monthly allowance is used first, then any remaining free-trial Panel Checks, then top-up credits.
- Top-up credits don't expire with time: they carry over from one allowance period to the next, and stay usable if your Pro subscription ends.
- Deleting your account deletes any unused top-up credits along with the rest of your account. They can't be restored afterwards, including by signing up again. If Apple refunds a pack, that pack's unused credits are removed.
What counts as one Panel Check
Ask and Second Opinion each use one Panel Check when you get a Panel Verdict, including a partial one where three of the four Panelists answered. Once you send a question it runs to the end; there is no way to cancel it, and leaving the screen does not stop it or change whether it is counted.
If two or more Panelists don't answer (they decline, an AI provider's safety filter blocks the question, or our own safety check withholds their answers), you get no Panel Verdict, and we show none of the answers we did get. This still uses a Panel Check, the same as any other run, including when the Panelists declined because the question was about suicide or self-harm (we show you support resources either way), and including when the step that produces the Panel Verdict was blocked or withheld: the AI calls were made, and the content sent decided the outcome. The same applies when some Panelists were unavailable because of a provider problem and at least one other didn't answer because of what was sent (a decline, a block, a withheld answer, or an answer that timed out or couldn't be used): the content decided the outcome, so the Panel Check is used. It is released only when every Panelist that failed did so on the provider's side.
A Panel Check is not used, and any reservation is released automatically, when:
- our own safety check stopped the question before it reached the Panelists;
- our safety check stopped the whole run because a Panelist's answer, or the Panel Verdict, may involve sexual content about someone under 18 (we also delete everything from that run);
- the run failed because of us or an AI provider (an outage, a provider refusing to serve us, or an error of ours) rather than because of what was sent.
A run that fails because of what was sent (for example, an answer too long for us to analyse, or a question built to break the analysis) is counted like a completed one. See our Usage Policy for the full detail on how we check questions and answers.
Payment, renewal, and cancellation
- All payments are processed by Apple through the App Store, which sells The Panel's subscriptions and credits on our behalf (in some countries as our agent, in others in its own name). We do not receive or store your card details.
- How the subscription renews. The Panel Pro is an automatically renewing subscription. It continues, and Apple charges the price shown for your storefront at the start of each new monthly or annual period, until you cancel. Auto-renew must be turned off at least 24 hours before the end of the current period to stop the next charge.
- How to cancel. Cancel at any time in Settings → your name → Subscriptions, or with the Manage Subscription button in the app. Cancelling stops the next renewal; you keep Pro until the end of the period you have already paid for.
- Apple processes App Store purchases and decides App Store refund requests under its own policies. Ask Apple at https://reportaproblem.apple.com (or in the App Store: your account → Purchase History); if we have closed your account, the Request a refund button on that screen takes you there. We will never ask Apple to refuse a refund. Nothing in these Terms limits any refund your local law gives you.
- Prices shown in the app reflect App Store pricing for your storefront and may change; Apple will notify you of price changes to an existing subscription, and ask for your agreement where required, under its own policies.
- Deleting your Panel account does not automatically cancel an active Apple subscription. Cancel separately in App Store subscription settings. It does delete any unused Panel Checks and top-up credits on the account.
- If you switch between monthly and annual billing, only the billing interval changes; your monthly allowance stays 50 Panel Checks and your reset date does not move. If you upgrade from Free to Pro partway through an allowance period, you receive the full 50 for the remainder of that period. If your subscription lapses and you resubscribe within the same allowance period, your allowance for that period is topped up to 50 remaining checks (not added on top of unused ones from before the lapse); resubscribing after a lapse also resets your reset date to the new subscription date.
Apple's licence terms
Your licence to download and use the app itself comes from Apple's standard Licensed Application End User License Agreement (the "Apple EULA", https://www.apple.com/legal/internet-services/itunes/dev/stdeula/), which applies because you got The Panel from the App Store. These Terms cover the service: your account, Panel Checks, subscriptions, credits and content. If the two conflict, the Apple EULA controls only for the licence to the app software and for Apple's own rights; these Terms control for everything else. Where both limit our liability, the limit more favourable to you applies.
9. Allowance and usage rules
- Our server keeps the record of your Panel Check allowance and of whether a run used one, and the app shows you that record. If you think a run was counted by mistake, email support@appsbynikki.com with its reference code; we'll check it and restore the Panel Check if we got it wrong. Our record is not the final word: you keep every right to challenge it, including before a consumer regulator or a court.
- Pro allowance periods reset monthly on your subscription date (UTC), not on the 1st of the calendar month. See §8.
- We apply per-account and product-wide limits on how quickly you can start runs, and on what runs cost us, to keep the service available and prevent abuse; if you hit one, you'll see a message saying when you can continue. These limits exist to protect the service, not to reduce your paid allowance.
- Fair use. If the Panel Checks run from your account in one day cost us far more than any ordinary day's use (a limit set well above what a full monthly allowance plus the maximum top-up credits can reach), new Panel Checks from your account pause until the day has passed. Nothing is deducted: your unused credits and allowance are kept, and the app tells you when they are available again. Repeatedly causing runs to fail in ways that are refunded can pause your account for a day in the same way. These pauses are decided automatically.
- Some runs may be stopped, or may not use a Panel Check, under the safety rules in our Usage Policy. See the Usage Policy for exactly when and why.
10. Availability and changes to the service
The Panel will change over time. For example, a Panelist's AI model may be replaced when a provider retires it, and features may be fixed or redesigned. If a change would take away something you have paid for, or reduce what Pro includes, we treat it as a change to these Terms under §16: you get at least 30 days' notice in the app, and the change reaches you only from your next renewal after that notice, so you can cancel before it applies. If an AI provider withdraws a model without warning, we'll tell you as soon as we can.
If we decide to close The Panel entirely, we'll tell you in the app at least 30 days beforehand and stop selling new subscriptions and credits when we announce it. If we close it before the end of a period you've paid for, you can ask Apple for a refund at https://reportaproblem.apple.com; if Apple doesn't refund you, email support@appsbynikki.com and we'll refund the unused part of that period, and any top-up credits you bought and hadn't used, ourselves.
Either way, your rights under consumer law (§13) still apply. We don't promise the service will always be available or free of errors, but that doesn't reduce your rights if it isn't provided as described.
11. Closing your account
You can delete your account at any time in Account → Data & privacy, which requires re-authenticating with Sign in with Apple. Deleting it deletes any unused Panel Checks and top-up credits, which can't be restored (§8), and free-trial Panel Checks you've used stay used if you sign up again with the same Apple ID. Pro Panel Checks already used in the current subscription period also stay used if the same App Store subscription is linked to a new account before that period ends. See the Privacy Policy for exactly what is deleted and what limited, non-content information is retained.
We may also close your account under the rules in our Usage Policy (for repeated serious misuse, for content involving the sexual exploitation of a minor, for a serious attack on our systems or security, or where the law requires it) and never for a minor breach. Our automated checks flag an account; a person decides whether to close it. The Usage Policy explains how to appeal.
After closure, you can still sign in to export your data, delete your account, and manage or cancel your subscription.
Money. When we close your account:
- your free Panel Checks end;
- Apple processes App Store purchases and decides refund requests under its own policies. Use the Request a refund button we show you. We will never ask Apple to refuse a refund;
- nothing in this section limits any refund, or any other right, that your local law gives you.
Your subscription keeps renewing until you cancel it. Closing your Panel account, or us closing it, does not cancel an active Apple subscription: it keeps renewing until you cancel it with Apple. We can't cancel it for you. Use the Manage Subscription button we show you, or Settings → your name → Subscriptions.
If an AI provider stops serving your account. An AI provider can decide, on its own, not to answer questions from your account. We can't reverse that decision. If it stops us from providing The Panel to you, we'll let you know. That is not a finding that you broke these Terms or our Usage Policy. If this means you can't use The Panel for a period you've already paid for, you can ask Apple for a refund at https://reportaproblem.apple.com, and your rights under consumer law (§13) apply.
Appeals. If you think we closed your account, or counted something against it, by mistake, email support@appsbynikki.com and quote the reference code shown on the relevant screen. See our Usage Policy for how appeals work.
12. Intellectual property and trademarks
The Panel, its design, and its own analysis technology are owned by us or our licensors. "ChatGPT"/"OpenAI," "Gemini"/"Google," "Claude"/"Anthropic," and "Grok"/"xAI" are trademarks of their respective owners. Their use in The Panel identifies which AI system produced a given answer, or which company receives your content; it does not imply that any of these companies endorses, sponsors, or is affiliated with The Panel, and no such affiliation exists unless separately and explicitly stated.
13. Your consumer rights, disclaimers and limitation of liability
Your consumer rights come first. If you are a consumer, nothing in this section, or anywhere else in these Terms, excludes, restricts or changes any right or remedy that the law where you live gives you and that can't be excluded by contract. In particular:
- Australia. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us, and to a refund for the unused portion or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
- New Zealand. If you use The Panel for personal, domestic or household purposes, you have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 that these Terms do not exclude or limit, whether The Panel is treated as goods (software) or services.
- Canada. Nothing in these Terms excludes or limits a warranty, condition, right or remedy that your province's or territory's consumer-protection law gives you and does not allow to be excluded: for example, the warranty under Ontario's Consumer Protection Act, 2002 that services are of reasonably acceptable quality. If you are a consumer in Québec, see the statement immediately below.
- Singapore. Liability for death or personal injury caused by negligence cannot be excluded; other limits on our liability for negligence or breach of contract apply only so far as they are reasonable under the Unfair Contract Terms Act 1977, and nothing in these Terms limits your rights under the Consumer Protection (Fair Trading) Act 2003.
- Philippines. Liability for fraud, which cannot be waived, and any liability under the Consumer Act of the Philippines that cannot be reduced by contract.
- United States. The exclusions and limits below apply only as far as the law of your state allows. If you live in New Jersey: the exclusion of incidental, consequential, special and punitive damages, the liability limit in this section, and the responsibility clause in §14 apply to you only to the extent New Jersey law permits. We are not aware of any other provision of these Terms that is void or unenforceable in New Jersey.
- United Kingdom (The Panel isn't offered there, but if UK law applies to you): liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under UK law, including your statutory rights under the Consumer Rights Act 2015.

The rest of this section applies only as far as the law where you live allows.
If you are a consumer in Québec: the next two paragraphs (the "as is" disclaimer and the limits on our liability) do not apply to you, because Québec's Consumer Protection Act does not allow them. Your rights under that Act and the Civil Code of Québec apply in full.
The Panel is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated outputs will be accurate, complete, or suitable for your purposes (§4).
We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, arising from your use of or inability to use The Panel, even if we were told they were possible. Our total liability for all claims arising from these Terms or your use of The Panel is limited to the greater of (a) the amount you paid for The Panel in the 12 months before the event that gave rise to the claim, and (b) USD 100 (or the equivalent in your local currency).
These limits never apply to our fraud, bad faith, gross negligence or willful misconduct, to death or personal injury caused by our negligence, or to any other liability that cannot be limited or excluded under applicable law, including the consumer rights described at the start of this section.
14. Responsibility for your own conduct
If someone else brings a claim against us because you intentionally broke §5 or our Usage Policy, or because content you submitted infringed someone's rights or broke the law, you agree to cover the reasonable costs, losses and damages that claim causes us, to the extent you caused them and as far as the law where you live allows. This never applies to anything caused by our own breach of these Terms, our negligence, a defect in The Panel, or your ordinary use of The Panel as these Terms allow. We will tell you promptly about any such claim and let you take part in responding to it. This section does not limit any right you have under consumer law (§13).
15. Governing law and disputes
Talk to us first. If something goes wrong, please email support@appsbynikki.com describing it and what you would like us to do, and give us 30 days to try to put it right. This is a request, not a condition: it doesn't stop you contacting a consumer or privacy regulator at any time, and it doesn't shorten or pause any deadline for your claim. We aim to reply to complaints within 7 days.
Governing law. These Terms are governed by the laws of the Republic of the Philippines, where the developer of The Panel is based, without regard to conflict-of-law rules. This does not take away the protection of any law of the country, state or province where you live that can't be excluded by contract: if that law gives you a right that Philippine law doesn't, or says a term of these Terms doesn't apply to you, you keep that right and that term doesn't apply to you.
If you are a consumer in Québec: the next paragraph does not apply to you. You can bring a claim before the Québec courts, and nothing in these Terms requires you to use arbitration or stops you from bringing or joining a class action. The mandatory protections of Québec law apply to you whatever these Terms say about governing law.
Where to bring a claim. You can bring a claim against us in the courts of the Philippines, or in the courts (including small-claims courts and tribunals, such as New Zealand's Disputes Tribunal) of the place where you live. If we bring a claim against you, we will bring it only in the courts of the place where you live. Nothing in these Terms requires you to use arbitration or stops you from bringing or joining a class action, or from complaining to a regulator, for example the ACCC or your state or territory consumer agency in Australia, or the Commerce Commission in New Zealand.
16. Changes to these Terms
We may change these Terms and our Usage Policy, including the rules about Panel Checks, limits and how the service works. We won't use this section to change the price of a subscription you already have, what kind of service The Panel is, or how long your subscription lasts; price changes go through Apple, which asks for your agreement where required.
Material changes. At least 30 days before a material change takes effect, we'll show you a written notice in the app that sets out the new wording (with the wording it replaces), the date it takes effect, why we're making it, and your right to refuse it. A change that increases what you owe or reduces what we provide applies to an existing subscription only from your next renewal after that notice, so you can refuse it by cancelling before then at no cost. If such a change still reaches you before you could cancel, you can refuse it and cancel, at no cost and without any penalty, up to 30 days after it takes effect: ask Apple for a refund with the Request a refund button, and if Apple doesn't refund you, email support@appsbynikki.com and we'll refund the unused part of the period ourselves.
Continuing to use The Panel after a change takes effect does not, by itself, count as accepting a material change: where the app asks you to review and accept updated Terms, only that action counts. If you haven't accepted a material change when it takes effect, the version you last accepted keeps applying to you until the end of any period you have already paid for; after that, you'll need to accept the new version to start new Panel Checks, and you can still sign in to export your data, delete your account, and manage or cancel your subscription.
Other changes. Changes that aren't material (for example, clearer wording or a new contact detail) take effect when we post them, with the "Last updated" date above changed.
Changes to what data we send to AI providers are governed by the Privacy Policy's re-consent process, not by this section alone.

18. Apple
Apple is not a party to these Terms and is not responsible for The Panel, its content, support, or any claim about it; we are. Solely with respect to your use of The Panel on Apple platforms, Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, may enforce them against you.
19. General
- Whole agreement. These Terms, including the Usage Policy, are the whole agreement between you and us about The Panel, alongside the Apple EULA for the app itself (§8).
- Severability. If a court finds part of these Terms unenforceable, that part is enforced as far as the law allows and the rest stays in effect.
- No waiver. If we don't enforce a term straight away, we haven't given up the right to enforce it later.
- Transfer. You can't transfer these Terms to someone else. We may transfer them to someone who takes over running The Panel, if they agree to honour these Terms and the Privacy Policy; we'll tell you in the app first.
- Survival. §§6, 12, 13, 14, 15 and this section continue after these Terms end.
